Malpractice Principles

The University of Michigan Health System will be responsible for a house officer's malpractice insurance coverage if the house officer is practicing in a University of Michigan hospital or clinic.

Example:
A University of Michigan house officer on an assigned rotation will be covered by the UMHS malpractice insurance when practicing in one of the UMHS hospitals or wholly owned and operated clinics.

Principle: A Special Purpose Trainee, as defined by the Medical Staff Bylaws*, who is credentialed, will be covered by the UMHS malpractice insurance when practicing in one of the UMHS hospitals or wholly owned and operated clinics if the rotation information and credentialing documentation is provided in advance (at least two months) of the proposed start date.

*ARTICLE IV
Categories and Designations of the Medical Staff and Trainees

4.9 Special Purpose Trainees
Special Purpose Trainees consist of Practitioners currently enrolled in a formal education program at an outside institution for whom a temporary educational rotation on a clinical service within UMH of less than one year has been arranged with the institution sponsoring the formal education program. Although not Members, these individuals are involved in the diagnosis of patient illnesses and their treatment under the direction of an Active, Courtesy, and/or Honorary Staff Member. HEB shall have the authority to assign Special Purpose Trainees to a specific Service and grant admitting privileges upon the recommendation of the appropriate Department Chair and with the concurrence of the Credentials Committee and ECCA. Special Purpose Trainees are not eligible for committee membership, may not vote on the Medical Staff and are not, nor are they required to become, members of, or pay dues to, the House Officer Association.

Examples:
A resident from Beaumont is approved to do a neonatal ICU rotation at Mott. She will be covered by the UMHS malpractice insurance, when practicing within the parameters of the neonatal ICU rotation, if she has completed and submitted the necessary information for credentialing at least 2 months prior to the scheduled start of the rotation and the Department of Pediatrics has submitted a rotation schedule to the Office of Graduate Medical Education.

A resident from Duke desires to take a Radiation Oncology rotation. The day he is scheduled to start he completes the paperwork necessary for credentialing. He is not credentialed and therefore will not be allowed to see patients and will not have malpractice insurance coverage until his credentialing packet has been reviewed and approved by the Credentials Committee and approved at ECCA.

Principle: The University of Michigan Health System will be responsible for a University of Michigan house officer's malpractice insurance if the house officer is practicing in a prospectively approved non-UMHS, non-hospital, ambulatory site. Such rotations, often at private physicians' clinics, must be approved by the GME Review Board in advance of the proposed rotation start date.

Examples:
A University of Michigan Internal Medicine house officer will be covered by the UMHS malpractice insurance when practicing at Dr. Gray's office in his assigned Continuity Clinic rotation. This experience is assigned and coordinated through the Program Director's office and approved through the UMHS GME office.

A University of Michigan Family Medicine house officer will be covered by the UMHS malpractice insurance when practicing at the Corner Health Clinic, as it is part of the formally recognized and approved Family Medicine training program.

A Pediatrics house officer arranges to spend two weeks during her vacation practicing with her uncle in his private clinic. She is not covered by the UMHS malpractice insurance as it is not an assigned rotation and is not approved through the GME Office.

Principle: The University of Michigan Health System will not provide malpractice coverage for University of Michigan house officers who are pursuing training opportunities at non-UMHS hospital affiliated ambulatory sites.

Example:
A Radiology house officer takes a rotation at a freestanding UCSF affiliated clinic. The malpractice insurance will be provided by UCSF.

Principle: The University of Michigan Health System will not provide malpractice coverage for University of Michigan house officers who are pursuing training opportunities at non-UMHS hospitals.

Example:
A Neurology house officer takes a rotation to learn about the care of stroke patients at Columbia. Columbia will provide malpractice insurance coverage.

An Internal Medicine Cardiology house officer pursues specialized training at Duke. Duke will provide the malpractice.

Principle: The University of Michigan Health System will not provide malpractice coverage for external moonlighting.

Example:
A resident moonlights at the Oakwood ER. The University of Michigan will not provide malpractice coverage.

Approved by the GME Review Board on March 23, 1999
